Much
like DNA, solid electronic discovery has the potential to provide
the "smoking gun" resulting in the negotiated resolution
of a civil case.
The electronic discovery process is quickly becoming
a critical element of civil litigation. The technology required
for electronic discovery and document processing is very specialized
requiring very specific hardware, software, and technical training.
In most cases, even the largest of organizations do not do their
own electronic discovery, and if they do, very often they destroy valuable
evidence along the way.
When considering
a litigation support team, think about the key factors. The same
technology is available to everyone in the computer forensics arena,
but is often cost prohibitive to smaller computer forensics firms.
So, one must seek out a firm with sufficient computing capacity
and the cutting edge technology to gain a competitive advantage.
Evidence collection is often a time sensitive matter
so it is important that the firm have enough staff depth to respond
in a timely and professional manner. Finally, the firm should have
mature, proven processes that will help the litigator and his or
her client throughout the litigation process.
